Retail establishments have some odd policies. In many cases, they won't employ security people, and even if they do, the "loss prevention" people aren't allowed to actually prevent losses, and routinely get fired for violating "store policy." So this isn't surprising at all:
- The family of an Uber driver who was hacked to death while on the job has sued Walmart, where authorities said the driver's teenage attacker stole weapons — a machete and knife — moments before the killing.
Grant Nelson's family filed suit in Cook County court Monday against Walmart and two companies that handled security for the retailer's Skokie store. Authorities allege that 16-year-old Eliza Wasni stole the machete and the knife from a Walmart about 3 a.m. May 30, then got into Nelson's car and hacked and stabbed him to death moments into the ride.
The wrongful death lawsuit said Walmart's security contractors were negligent because they failed to stop Wasni, question her or ask her to show a receipt as she allegedly left the store carrying the weapons.
According to the lawsuit, two Walmart employees or contractors were standing immediately in front of the door as Wasni exited, passing within feet of them.
Walmart said in a statement that its associates "acted properly."
"Act[ing] Properly must mean "let a shoplifter exit the store with a pair of edged weapons and make zero effort to stop her or hurt her feelings in any manner, regardless of the fact that she went outside to stab a man to death."
If someone can just walk into any location, take what they want, and walk out, then the entire economic system and social construct fails. Which is being demonstrated on a daily basis here in town we guess. It also doesn't seem to be a socially responsible corporate policy.

It would not have been worth the trouble to attempt to stop her, thus causing trouble, for such a small dollar amount of goods. A machete and knife are just tools that are not illegal to own.

Maybe they realized Kim Foxx won't bring charges on shoplifters since it's a "victimless crime." With her thought process, the Uber driver must not count as a victim.
Were the items worth more than $1,000.00? Remember La Kimesha Foxx is not following State law when it comes to charging shoplifters.

So an unarmed security guard is supposed to stop a crazy chick with a machete? I hold the 2 chicks who instead of calling the police, devide to follow and videotape the crzy vhick around the store. If they would have used their phones to call the police the uber guy would still be alive.....if the family of the crazy chick got her the mental help she so obviously needed....the uber guy would still be alive. I find fault with many people but the unarmed security at walmart isnt one of them......i guess walamrt now knows how the city feels when it gets sued for having nothing to do with nothing....

Using this family's logic, couldn't Wal-Mart argue it was a suicide because the Uber driver got gas while he was at Wal-Mart? Makes just as much sense, which is none!

This policy is the policy of many stores now if someone take something let them go it's happening everywhere don't be surprised when you see people walking out with items that's the new trend no wonder why so many stores are closing! The owners of many stores don't want their employees to get involved because they know the lawsuit filed by the criminal will cost to store money.

When there was a Walmart in Lakeview on Broadway, just north of Addison Street, there were signs in the bathrooms that said that shoplifting is a crime and that Walmart vigorously prosecutes shoplifters. These were Walmart produced signs, not generic signs. Seems like the signs establish that Walmart will stop and prosecute shoplifters, so the statement by Walmart corporation seems like BS.
As a retired CPD who spent years in the security business after retirement, I can tell you there are many major stores that prohibit their security officers from any physical contact with a customer, no matter the reason. A " customer" and I use that term lightly, can just walk past security carrying a TV and security will not lay a hand on them. The stores just do not want the possibility of a lawsuit when insurance will pay for the thefts. The same thing in banks. The security guard, if there is one, is armed. The guard is prohibited from interfering in a robbery and must let the stick-up man leave the bank. I won't name the numerous stores and banks on this site. But, I am sure the thieves know exactly the stores and banks I am talking about. And, lets not fail to mention some of our biggest teaching hospitals which want a " friendly environment". The thieves know full well that they can enter these hospitals just about any time day or night and steal from a patient's room or steal hospital equipment and supplies or pickpocket the patients and family members in the elevators or enter doctor's offices and steal computers and purses. If folks knew what went on they would faint.
Walmart must have heard of Kimmy's policies on retail theft. And Security seeing it was under $2000.00 just let the thief walk. Instead of suing Walmart, they should sue the States Attorney's Office and while their at it sue that little prick Dart the Fart.
I'm no fan of chase bank, but perhaps they grew tired of the whiny off duties who didn't show up on time or at all. You think they give a rip about one location on Cicero avenue?

Most of the time that's not even done. They just note in the case report that the stolen property was returned to the owner or victim

Happens all the time especially at stores like Walmart. Let the shoplifter flee, get a license number or description and file a case report. Then let CPD do the work of locating and arresting the offender only in many cases have the victim refuse to press charges and sign a complaint

Aside from Walmart, they're suing Allied Universal and Monterrey Security.

I talked to sheriffs who work at Walmart's on the 'Souff side'.
Its unbelievable.. They shoplift the store blind.
I have not idea how they stay in business other that passing the loss to customers in better neighborhoods who now have to pay higher prices.

Security personnel are in place to prevent financial loss to their parent company (in this case walmart). They are not in place to prevent what people do with products sold (or stolen) from Walmart. That would theoretically involve Walmart having to investigate each an every persons intent when they leave a store. Another thing, how in the fuck is Walmart responsible for what a crazy broad does with items she STOLE???

Ok, so an $8/hr employee may or may not have an eagle eye on everybody, but they are also prohibited to challenge a
measly theft patron. Checking receipts is not going to detect any items concealed and who knows, maybe she lied and said the item was hers when she came into the store. Clerks give the patron the benefit of the doubt. Retailers have limits and budgets for loss prevention. Lots of stuff walks through the doors. Many have a policy that if isn't on camera it isn't a theft and the store policy is to not stop a patron.
Individual rules may apply. If you violate store policy you lose your $8 hr job.
So, If she stole a trombone and she decided to try it out in the Uber, startling the driver and caused him to crash into an oncoming cement truck, who's at fault for the death/injury of the driver?
How do the lawyers get to blame a Retailer for the actions of a deranged maniac?

Sorry folks, we own a retail business. Unless the theft is north of $1,000 it has been made abundantly clear the State's Attorney is not doing a thing about it. If this whackbag is stealing a big knife and a machete, why would a $10/ hour security geek get between her and the door? The choices for them are certainly unappealing, particularly if the corporate policy is not to engage the bad guy physically. Get fired, get sued, get killed. Lay this one at the hands of the State's Attorney for starters.

Nephew works at home depot and he told me that a shoplifter there took a bunch of tools, walked out employees went out after him,and all 3 employees were immediately terminated. They were told store policy is "do not confront shoplifters call the police" Why even bother paying for anything? Getting to the point of who gives a shit! This city county state is so full of corruption and dirty swamp water it is overflowing when you see the mayor and his cabal defiantly disobeying federal immigration laws, the thugs and criminals see this and know it starts and the top and shit flows down so they commit crimes like their mentors the democratic criminal machine! As the president removes billions in needed federal aid we will be at "junk status" by Friday which means no one will lend any money to this master of corruption satte-city-county!

this has been the policy of many banks for more then a few years. I worked armed bank security when I retired for a year or so and was told outright do nothing if the bank is robbed. The only action you take is to observe and call the police. No shootouts with the risk of hitting grandma. But, to tell you how stupid these bank robbers are, the Chase bank in Palos Heights has the tellers completely enclosed in bullet resistant glass. That did not stop two people from coming in and announcing a stickup only to find the bullet proof glass. They left with nothing and were soon caught.

Rarely do I see a cop upset that they are not supposed to do anything but stand there. If they want to pay you to call on-duty police, what's the big deal?
If the family wants to go after some deep pockets, go after Uber. It was their policy that prohibited the driver from lawfully carrying a firearm. It was their policy that sent him out defenseless in what is becoming an increasingly dangerous job.

Lawsuits scaring everyone that has a nickel in the bank. Reckon it's up to people that have to pay higher and higher prices to start "educating" shoplifters. People living paycheck to paycheck that lawyers can't squeeze a million dollars out of.
