Lambs Lined Up

  • Chicago's police oversight agency has recommended that three officers be fired for shootings the agency ruled unjustified, officials said.

    Last week, the Independent Police Review Authority ruled that officers in two separate cases shot into vehicles even though the officers were in no serious danger.

    The agency's recent rulings — made as city officials continue to cope with public outrage over police practices — represent a shift for an agency that had previously justified almost every shooting by an officer. IPRA has ruled more shootings unjustified over the past 1 1/2 months than it had in the previous nine years.
That tells us that this is a political move, "mob justice" if you like. The first shooting is from 2013, the other from 2015. Both involve vehicles.
  • In one of the cases the agency ruled on last week, [the officer] shot Ryan Rogers to death in East Hazel Crest in 2013 while the officer was on a special assignment investigating robberies in the city and suburbs, records show. [The officer] told IPRA investigators that he shot four times because Rogers drove an SUV at him, records show, but IPRA's ruling said the evidence showed that he fired at least one shot after he was no longer in peril.
So three shots were justified, but the fourth wasn't? Because someone who showed no hesitation about aiming a ton of metal at an officer wasn't a fleeing felon who would have run down anyone else in his path to get away?
  • In the other case, records show, [Officer A and Officer B] shot and wounded a man who drove off in his SUV as the police tried to stop him after an alleged drug transaction on the South Side in 2015. In its ruling, IPRA noted that the bullet trajectories indicated the officers were standing alongside the SUV during the shooting, not in its path.
General Order 03-02-03, II-A:
  • A sworn member is justified in using force likely to cause death or great bodily harm only when he or she reasonably believes that such force is necessary:

    1. to prevent death or great bodily harm to the sworn member or to another person, or:
    2. to prevent an arrest from being defeated by resistance or escape and the sworn member reasonably believes that the person to be arrested:

    a. has committed or has attempted to commit a forcible felony which involves the infliction, threatened infliction, or threatened use of physical force likely to cause death or great bodily harm or;
    b. is attempting to escape by use of a deadly weapon or;
    c. otherwise indicates that he or she will endanger human life or inflict great bodily harm unless arrested without delay,
Forcible Felony - like the attempted murder of a Police Officer? Deadly weapon - like a car? Will endanger human life - like driving a hunk of metal at a human being? We just tore this apart with almost no effort. Imagine what a lawyer could do.

These are crap-tacular efforts to find something administratively to fuck coppers on, because they know legally there is as little evidence as the Baltimore prosecutor had railroading six cops. IPRA is looking for scalps - don't be their trophy.

The next move is up to Special Ed - a guy who can't even keep his lies straight about his girlfriend cheating her way to a crooked promotion along with Wysinger's wife and half of IAD. Anyone think he's going to do the right thing? Or the thing that keeps the spotlight off his own dirty house?

Media never brings up non-shooting cases. You know, cases where cops are completely screwed over. Remember ipra is NOT a court and doesn't need actual evidence to hang you. They only show you and your lawyer during initial questioning what helps them. If there is a video of you punching someone, and another of you being punched first, ipra will not show that until police board. Don't have to give it up. I've been through their misery. Took 60 days, got cut down to 3 after all evidence. Be careful, they now out for blood

This transpired roughly 6 weeks ago. The offender has a Cook Co DOC connection, as in being released from custody for UUW while on probation. Any remorse from Dart the Fart? The powers that be have not problem sacrificing the careers of a few officers upon the altar of politics, and it does not matter to them if the officers were in the right.

Think about that when you are deciding whether to stop that car without notifying the zone, chase some single-rock carrying thug, or reach into the pockets of some filthy, bust-out, white heroin addict scumbag from the burbs without considering the risk of being poked with a used needle. NOTHING happens to them after the arrest. NOTHING. Therefore, it is a waste of all of our time. Not a LEO here but I have question. If the IPRA is a civilian review with no law enforcement credentials is the LEO required to make a statement?
I understand that a post shooting narrative is required to the IAD and SA but if the IPRA is not " certified" can the LEO just say piss up a rope?
And if there are no ramifications why don't all CPO's say the same thing ?
If it is required it might be something that the FOP should include with the next contract negotiations.

I have no idea of what the copper from 025 is speaking of since I don't come here that often. My only plea to him is THINK!! When I came through the academy we had a copper who walked into our home room and shouted "THINK" in the deepest pipes I ever heard. Most of us were like WTF is he talking about. Well some 25 years later his words are still loud and clear in my head. Do whatever you think will keep your family living the life that you are providing for them, but NEVER FORGET you are only a split second away from the next "witch hunt". PLEASE stay safe but remember the department is NOT behind you; correction, they are but ONLY to put a knife in your back.

The Hazel Crest shooting was absolutely 100% justified. The officer was hit by the car and then almost crushed between two cars. Because one bullet went through the back window which took less than a quarter of a second for the car to move that distance, completely shows how justified this shooting is.

This is the beginning a "Trend" that began in Canada. There an officer shot someone on a bus. The subject was clearly a threat, but because of public outrage.(the deceased was not White) So the court made an interesting ruling:they said the first shots were justified, however the other shot were excessive, and constituted Attempted Murder! This concept allows the court to straddle the fence and in essence produce Two Separate Rulings on the same case! Expect to see something like this in the Van Dyke case, since he clearly had justification for the first few shots, but the others where the deceased was already on the ground, will be the issue. I agree. Now going to work is not only scary financially but even more dangerous physically. Lately my wife and I have been discussing my leaving this job as soon as I hit my 20 years. Already been putting together a rough draft of a resume with other ideas for the private sector. I never would have even thought about doing such a thing a year ago. Very sad what happened to this once admirable job.

Fly on the Wall: As I posted last week about one of these shooting, the recommendations are coming from the Mayor's Office and the Corporation Council. Secondly: Sharon Farley's position is safe, just like the Superintendent she is following orders from the Mayor. There is a old saying, be careful with what you wish for! For years I have read posts about IPRA and how bad they were. How many times did people post: IPRA sucks, IPRA don't know what they are doing, or all IPRA wants to do is jam PO's. Let's see, up until a year ago IPRA investigated 408 shootings and only found 2 were not justified. Since Rahm put his puppet Farley in how many shootings have been classified as unjustified? Add the fact that IPRA just classified only 2/3 percent of the excessive force complaints as sustained how bad were they? I admit there were several PO's who should not have received punishment(one is one too many) but overall the record was not as bad as one would think. Like I previously stated be careful what you ask for and unfortunately you got what you asked for. Unfortunately you got Rahm and Rahm' is pandering to his people.

This will be the defining moment for ipra, the city, the department and Johnson. This was done strategically. If Johnson agrees to fire them then he is taking things seriously and everyone looks good. If uses the law and his conscience and keeps them then ipra proves its existence and points the finger at the department and says we are trying to do good but the department won't take our findings seriously. I see Johnson going the safe route and firing them and letting the court give them the job back.. Then everyone washes their hands of it and in the end years from now when everything dies down and possibly a new supt is in place they can all blame the court. Watch for the safe play to be made.

There's more who got the Lt test and answers from the now-retired NOBLE chief. Others from HQ were in that first group. Merit promoted twice and miraculously scores high to get promoted in the first group.

If IPRA recommends firing the officers in these two incidents, and Johnson approves, then it goes to the corporation counsel for their recommendations. If the lawyers agree then charges are brought up and the matter goes to the police board. Remember the police board said we are all racists so I don't imagine that these guys will get a fair shake. The only option then is the courts. A mess for sure and unfair .

Also in rthe current climate it is not easy to just go to court and get the job back. Those days are over. Just this month the appellate court sided with the circuit court when they up held the firing of Chicago Police officers in two separate cases.

troll: Up above some wondered why citizens on the IPRA are investigating the police instead of IAD or S/A investigators. I suspect it is because IAD is too close to the CPD and would not be independent enough. And the obvious answer of why the S/A does not investigate police misconduct is because corruption and incompetence in the office of the Cook County States Attorney is not unique either. But I agree, a citzen IPRA is probably the worse of the three options. Maybe it should be a panel of nuns who investigate. If I remember, they always seemed to get to the bottom of everything and most often it was me and my friends that took the hit. And they were always right.

If ipra stands their ground, it will end up at the police board as well. Police board takes about 2 years. I predict eddie will agree with ipra because he knows nothing about police shootings/deadly force. He was lost as a Sgt in Area 4.

From the information provided it appears the officers acted appropriately and in compliance with Department procedures and policy. If the Police Department terminates their employment, they should hire counsel and file suit. If the facts you present are accurate, I'm sure the courts will eventually reinstate them in their law enforcement positions with substantial back pay and perhaps significant damages for emotional distress after all the City inappropriately put the officers and their families through.

I am someone who worked at IAD for years. Every recommendation for dismissal goes to the Corp Counsel for review. It does not mean much because I have seen the counsel NOT recommend dismissal but the case moved forward anyway and vice versa. The review of the city attorney is just a review for opinion, nothing more. So, know what you are talking about before you comment.

Rest shooting the offenser was wanted in multiple robberies, got into his car was stopped by police and used his car in an attempt to get away. The copper who was behind the car in the driveway fired four shots in fear of his life killing the offender. IPRA originally cleared the officer the county called it a good shooting. Now IPRA suggests that the fourth shots trajectory suggests that he was not behind the car and it wasn't appropriate and you want to fire this guy. Are kidding me? Have our backs? Do police work? Hey Eddie you fire this guy and police work is over!

Tell that to both Sgt. Lesner and Po McDermott who both were fired, lost their cases in the circuit court and now have been turned down by the appeals court. One was for a 10 plus year photo

Not a LEO, just a cityworker. Cities run by Democrats are depending on firing hundreds of LEOs on a regular basis. Turn over the department for younger, cheaper workers and get out of paying pension benefits.

Hot damn! I've been saying this for years. The city want you to retire early and pay partial pension. They can hire two yes men for the price of one old timer. Why are so many old timers going to "random"? They want to catch you so they can fire you and not pay ANY pension. Well test me everyday. I'm staying until I get a full pension and some VRI,parks,CTA and any other money I can, not for me but for my family. If I drop dead so be it my family will be ok.

If you can retire and decide to stay due to "extra cash" as you leave your total pension on the table, minus that from your yearly salary and everyday you stay you subject yourself to losing your pension-freedom-family they are trying everything to screw coppers make them lose everything to keep their jobs! If you can retire and don't i will never buy a ticket to your fundraiser for acting "stupidly."

I am pretty sure it does not make one iota of difference what the department rules say if a state law was violated. Clearly state law has precedence over department rules.

Department rules are no cover for violations of state law.

The real issue would be whether there was a violation of state law. It is pretty hard to see how anyone could be expected to stop shooting at someone after some fixed number of shots. That is an unrealistic view of the reality of having to shoot at someone, in a vehicle or not.

Personally, I have serious concerns about shooting at moving vehicles. I would just as soon not see a miss kill some innocent nun walking down the sidewalk half a block away. Among other things it is really bad PR.

Just wait till they release all the CR's from 1967 till present. IPRA is going to go over every shooting and if there's a chance they can change it they will even if the officers are retired she will open the case again and find fault with it and deem it an unjustifiable shooting. What does that do you ask. It opens the door for lawyers suing the police and city and she will also turn the cases over to Kim Fox and the US attorneys office for possible prosecution. So hang on boys and girls the ride maybe getting rough.
