End of the Road?

  • The Chicago Police Department took action Wednesday to fire a police lieutenant and suspend two other officers for their handling of the 2004 homicide investigation of David Koschman, who died after a struggle with the nephew of former Mayor Richard M. Daley, according to the department.

    In a statement released Wednesday, interim Police Superintendent John Escalante said he is seeking the termination of Lt. Denis Walsh and a one-year, unpaid suspension for Sgt. Sam Cirone who “did not properly follow department policies” when they were investigating the death of David Koschman.

    The department has filed charges with the Chicago Police Board after which the board will schedule a status date for the officers.

    Also Wednesday, Escalante announced a one-year suspension without pay for a third officer, Det. Nicholas Spanos. That action does not require the police board's approval. Spanos has 10 work days to decide whether to accept the punishment, file a grievance or appeal with the police board.
The big big bosses (most of them) left already after being presented with an ultimatum - retire or face Departmental charges, thereby endangering your pension. Cerone and Spanos, the two least culpable whose sin was they did not know haw to say NO to bigger bosses, will come out okay, after one year. You would be naive if you thought the police board could not be influenced by the Irish mafia to the extent that Walsh would see his penalty reduced. That being said, someone such as the FBI needs to take a road trip to the penitentiary and interview Escalante's and Cline's paid informant who received $800,000.00 over four years while committing two murders while a paid informant and ask if any police officers were given any of the money as a tribute.

For years Walsh has gotten away with shit that the rest of us would have been fired (and maybe jailed) for. Sam was just trying to stay in the "club." And Nick is getting shafted for doing what he was told. If he had refused to investigate and write the report how the brass (and Daley because we all know he was behind this shit for jump!), he would have been nailed for disobeying an order. The worst thing about it is that none of them have any real "gotcha" information on the Machine to spill now that have been sacrificed by that Machine. They are underlings, not part of the inside Cabal. They kind of know how things work, maybe have a few private phone numbers in their phone, but nothing more. They most certainly did not have any "real knowledge" that may have helped them out. If they did they wouldn't have been bounced.

They were useful fodder for the machine's cannon. A lesson to be learned by the rest of you. Keep your integrity. It is far more valuable to have than any chit you think the Machine will pay out on.

This has been going on for a good while. Wasn't there a follow up investigation? What happened with that cover up and those people involved? Did the department have their backs and give them the heads up to pull the pin, just in time?

When O.W. Wilson came in to reform the CPD Old man Daley gave him hands off. The first things that he did was change the Chiefs title from commissioner to superintendent then move the superintendents office out of city hall in to police headquarters at 11th and State. All of the 41 or so stations were aligned with the ward offices so the politicians had control over who held what rank and position (station detective, desk sergeant, watch commander etc.) so he changed the boundaries into 21.districts covering several political wards. Changed the color of squad cars from black and white with red gum ball to blue and whit blue gum ball. Then he merged the Park District Police with the city police. The park district police patrolled the parks and boulevards that a lot of the previous mayos and then current politicians lived on. Then he gave honest tests for people to keep their rank and promoted the truly knowledgeable. No merit BS, No oral board BS, no more "Fins and blowjobs" gentleman
If they want a new police department then you need to change the political structure of the police department and the promotional process and raise the standards for entry not lower then. Do the Feds lower their standards for appointment? They just look a little harder from all over the country.

I worked with all three...Nick, great friend and detective; he got caught between two narcissists and chose to allow Sgt Cirone to edit his report and then file it with included nonsense about "mutual combatants." Sgt and Lt were always shady and just holding a "cool" spot until the next merit opportunity came along.

This whole case, from exempt on down was just another example why this department has no future. SCC said it in a previous post about how top heavy we are with double, triple merit "placeholders" that have had no experience except with their "handlers."

Interesting: Big Question, now that have charges and elect to retire, they will a pension no doubt and they should. But will they give them a retired star and id card. I know many officers who retired with an open cr and were not give reitired id cards or stars. THey were classified as retired while under investigation. If that happens they are not eligible for an IROC. I disagree with this classification, any officer who is collecting their pension should be eligible for an IROC.

If he is vested, yes he keeps his pension. Burge was fired and kept his pension because he was not convicted of a felony while working. You can always retire while the case is pending if you so choose and also keep the pension.

How many people that are calling "off with his head" really know more about this case then just from skim reading a series of Sun Times articles?

I don't know what exactly transpired, I wasn't there. Here's what I do know.

1. I do know I don't trust the media to tell the whole story, especially the Sun Times (actually the Tribune is just as bad now)
2. I do know as a detective that people will refuse to talk to you and also lie, just as they did when I was a P.O. And even when you want to charge them with obstruction we all know nothing is going to happen
3. I do know as a detective that a suspect can change his appearance before being arrested and put in a line up. You have no control over that. A guy with long hair shaves his head etc. I know you can only do the best you can do with fillers and most importantly you cannot influence the witness to pick out who you believe is the suspect. What kind of a case do you have with witnesses who were out at 4am and no identification in a line up? This is in reference to the 2004 line up and all line ups.
4. I know that there is always enormous political and public pressure in high profile cases and that the police are always preselected as the fall guys for any and all issues.
5. This case has been reviewed for possible criminal charges and no one thinks there is a case, therefore how strong can all these accusations be?

Only these guys know what they did or didn't do. Only they should decide whether to accept the recommendation or not. The problem is that it doesn't finish there. Denis can walk away, the only thing that stings is no retirement star and no scholarship if there is one. He still gets his pension. It might be in his best interest to walk away, he has to face the police board which will be under scrutiny to uphold the firing. However if he has dirt on someone, the board will give him 18 months and down the road somewhere there will be a quiet job somewhere for him.

Cirone is facing a year. It is strange that as a supervisor he is not being recommended for a higher penalty than his subordinate Spanos. Again it may not end at that. If they choose the Board they are subject to harsher penalties or firing. Go to an arbitrator who is impartial to all the political crap and will make a sound decision.

Obviously most people think that this type of thing couldn't happen to them. Think again, the media has been taking turns looking at disciplinary cases after receiving all this information from FOIA. The media is our human resources department right now and God help you if they pick up one of your beefs and run with it, because the Dept will only help you find a chair at 376 while deciding if they can sacrifice you to the media and public.

At one time I knew and at some time while on the job worked under each one of their fathers who were all clouted bosses. This job has never been and will never be legit. Be honest with yourselves all of us in our 30 years on the job watched many good coppers get suspended maybe even take 30 pending for nothing serious while those who had clout were always untouchable no matter what they did.

As far as Walsh goes he was always a bad drinker and has always chased the babes. Neither he or his brother were ever good coppers but always had good promotions and good spots. The detective division has always been loaded with yes men like these guys from the lowest detective to the highest boss. These guys will cover up anything sell their souls to the devil and have no sense of the truth or justice and are basically immoral individuals who will cover up even the worst crimes for the "chosen."

What's sad and disturbing as a 30 year cop, is many of my fellow police officers will talk of what good guys, coppers or bosses scum like this are. No thanks I know the truth about these people and am sickened by the fact that because of scum like this the good men and women of the CPD are judged and scrutinized by the public and put in the same category.

Just being a knowledgeable, stand-up cop who wants to do the job right and take care of his people is often passed over. Denis Walsh has been untouchable in the past and will continue to be unscathed in the future.
Sam Cerone was an experienced detective and did a good job just a little to spoiled by Dean the Dream, both had it their way for a long time. The only one who will feel any pain is the detective on the bottom of the food chain, a good kid who did a good job but listened to the wrong advisers in this case.

The re-investigation of this case was originally offered to two other Area 5 homicide detectives (Initials M.L. and R.C.), two very good detectives with integrity. Of course they were experienced and smart enough to see the writing on the wall and one of them politely told Dean Andrews "Go Fuck Yourself. This is nothing but a can of worms and was completely fucked up from the initial investigation." Those who worked at Area 5 can probably guess who talked to Andrews like that, but I'll bet he's laughing his ass off now seeing how Dean the Queen ran and tucked tail, leaving everyone else hanging. I know he likes and respects Cirone and Spanos very much, so I'm sure he isn't too happy about what is happening to them. Way to go Mike, you were right and the asshole bosses were wrong, AS ALWAYS.

Nick was not forced to be one of the detectives assigned to reinvestigate this case. In fact two other detectives were asked to take this case before Nick and Jim, but those two were smart enough to see the writing on the wall and said absolutely not.

When you do a lousy, slipshod investigation and present it to a connected states attorney, then the police hide the files and then despite all of the public outcry and adverse comments from a judge and then despite the refusal of the prosecutor to appoint a special prosecutor, you get what you got. Corruption, deceit and lies by the officials involved. Then you get the comments about " mutual combat" and drunken fights and what a great guy all of these people are. For all you morons out there. Area 5 was assigned to re investigate the case after the press got a hold of it. Area 3 ran the initial investigation including a line up where No One was ID'd. No statements were given by the suspect. All parties had been drinking. The case was reviewed by ASA who rejected the charges. Case should have been closed then, but they left it suspended. Reopened later again suspect refused to speak, witnesses refused to speak, nothing changed. Only difference over zealous bosses trying to boost themselves, interjected and demanded particular wording be included in the report. This case was a loser on its own. Where phone calls made? probably but not needed. It was a "He said she said" case with no other evidence. If you don't know what it takes to get a case charged in Cook County you need to seel employment elsewhere.


Gilger is one of the most honest people I've known in 23 years on this job. He knew exactly what this case was. Spanos also a good/hard working detective. Were told by Daley's sister (Vanecko's mom) to go away "Who do I need to call to make this go away". Vanecko's friend, (McCarthy?) refused to let his wife speak. Who should be investigated?

Cirone, smart guy, but got caught up in the political BS to stay in the click.

Andrews, total egomaniac who thought he was better than every detective in the city because he had been in the "D" Unit most of his career, tho never as a Detective and never investigated anything.

Walsh, another egomaniac who thinks he's God's gift to police work. Area 3 is a much more pleasant place without him

First, Daley is no longer Mayor and none of the Illinois politicians like Rahm. If they did like Rahm Lisa Madigan never would have sent a letter to the Department of Justice asking for an investigation into the McDonald shooting. Daley and Madigan have separated themselves from Rahm. Rahm replaced most or all of the previous Daley appointed police board members with his own people. Rahm wants to show reform and transparency and what better way then to screw policeman involved in a Daley family cover up. I believe the police board will uphold or give them the max then they will appeal to a Crook County judge in the pocket of Burke or Daley and they will be exonerated or their punishment reduced.

I can see in the initial investigation that none of the people that were with Vanecko would cooperate, there was no video even though every bar on that street had video inside and out, line ups were conducted and no one was picked. I don't know and maybe I'm wrong but no phone records were ever subpoenaed, the suspects phone records are always subpoenaed in a homicide and the States Attorney always asked if that was done. Oh yeah and the best is giving a defense for the offender on paper and not justifying where it came from. Vanecko was the aggressor but no one provided us with the information we just hear heard it somewhere.

He did call it in. Asked for charges. Head of Felony Review personally responded to A/3 and rejected charges. Read the report and/or any of the numerous Sun-Times articles and educate yourself.

I'm retired and was not present at either investigation, but in the first investigation a state's attorney, Darren O'Brien, was present and filled out a felony review folder which he says he lost or threw away, I can't remember which. Having dealt with O'Brien on several occations I can tell you he is a pos, but that is neither here or there. As the shit began to hit the fan with Webb investigating O'Brien left the state attorney's office and I do not know what he is doing, nor do I care.

I would imagine that felony review was called in for advice as it would seem that there was not enough evidence or statements to even seek charges, so I doubt that charges were even requested.

As far as suspending the investigation, that is impossible if it is a homicide. It can only be classified as in progress, cleared open if there is one or more charged and still other unidentifed offenders or known offenders who are not in custody, or cleared closed if all offender(s) are in custody and charged.

It could also be cleared exceptionally if there was evidence, etc. and the asa refused to charge. I would imagine that the detectives would have jumped at this if they had evidence and O'Brien had rejected charges, so that is why I say that they probably only had an asa present for advice.

It seems to me Daren O'Brien came out and said "Hey, I won't approve it, so don't bother formally asking for charges." Ya, I get it. But it's up to the detective. You put the ball in the ASA's corner. "I am asking for charges - you just approve it or reject it." Game over. This would have amounted to nothing if that had happened. Walsh would not have then had to hide the files, and the Area 5 guys would never have had to fix Area 3's fuck -up.

Formally present charges on these cases. Game over.

So I'm pretty sure you're wrong, charges were never formally presented. Ad if you get your info from the Sun Times you;ve got problems.

That person brought it back and put it in the V/C Office on a file cabinet. WALSH found it and made the calls to tell everyone he found it. The case was at A/5 being re-investigated. The next day the working file turns up in an open locker in the Det. locker room. Each and every place had been previously searched................. That's why WALSH is in the shit storm. I really don't know how Vanecko's name got brought up in the investigation. If I had to guess I would say an anonymous tip perhaps, but an anonymous tip is still a good deal of legwork away from making an arrest and presenting a lineup.

As far as calling ASA, there are a certain amount of things that need to be done before presenting the case and state can tell you that they are not sending someone out yet if it is a minor case. Obviously with a murder they will send someone out at least to log your progress. Then another thing state likes to do is CI a case. Usually its for good reason to bolster a case. Sometimes is because they feel a case is not very strong but not weak enough to reject it. Sometimes they will come up with any reason to CI it because they don't want the rejection being on them. Again, I didn't work on this case or around it, but my guess it was headed for a HUGE CI. No matter which way you see it, I think this case was destined to remain open after the negative line up until further evidence appeared, whether it was CI or not presented. Then why was a Felony Review folder filled out by O'Brien? You know, the one he claims he tossed out or destroyed some time afterwards? And why was the Supe's legal assistant (a former ASA) called out to the area to lobby for charging?
And I don't get my info from the S/Ts...but even they address this fact. I was in the area at the time and know charges were formally requested. Any dick knows you can formally request charges, the ASA then must fill out the folder. They can then refuse to address the issue by calling it "an advice call-out" or "more investigation needed". Just because you formally ask for charges does not mean they must formally charge or reject it. And they do that for a reason. They know you are trying to put the ball in their court and this is their way of keeping it in yours.

The following is taken from Dan Webb's report on Koschman: "Tom Epach (a former Cook County ASA) was the Executive Assistant to Superintendent Cline in 2004 and acted as a liaison between CPD and SAO; on occasion advocating on behalf of

Do you call in a retail theft without an offender?

Most of the guys on here are talking out of their ass. Most are saying hang them without using one single fact or basis to back up their talk. They might have committed violations and they might not have. They may have sloppily handled a fucked up case and they may not have. I won't crucify them on presumption.

Learn the law, first. There might have been witnesses. You only need probable cause for charges. If the charges are denied, then you did your job.

If they had witnesses then how come the negative line up? Was it because it was dark out? Was it because they were drunk? Was it because they were blind? These are the pitfalls of a criminal case. I only need PC? I only need PC for an arrest you goof, not for charges. This isn't an on view drop dope case. Felony Review is a pre-trial of sorts. Is this case winnable or will the city and the officers/detectives be sued after a NG.

What's sad and disturbing as a 30 year cop, is many of my fellow police officers will talk of what good guys, coppers or bosses scum like this are. No thanks I know the truth about these people and am sickened by the fact that because of scum like this the good men and women of the CPD are judged and scrutinized by the public and put in the same category.

I'm not cutting and pasting, but Webb found that mayor Daley knew within hours of the incident occurring that his nephew was involved. This came from many interviews including the mayor himself and from his chief of staff Matt Crowl (former AUSA) who said someone from cpd notified him that vanecko was involved soon after it happened.

Webb also found that no where in any reports does it substantiate the finding of vanecko acting in self defense. No witnesses statements by either side said koschman threw the first punch. It's believed that cpd conjured up the self defense finding on their own without showing nor documenting evidence of such.

WALSH had nothing at all to do with the re-investigation. He found the Investigative file that had been missing. Some FUC&ING COWARD had that file. That person brought it back and put it in the V/C Office on a file cabinet. WALSH found it and made the calls to tell everyone he found it. The case was at A/5 being re-investigated. The next day the working file turns up in an open locker in the Det. locker room. Each and every place had been previously searched................. That's why WALSH is in the shit storm. Read the WEBB report. If you don't like his personality go tell him in person. If your a lazy do nothing or you do half assed investigations ...... look at yourself in the mirror

Pretty much on the money. There is no evidence whatsoever that he hid the file. Only suspicion. So you have to look for motivation. What was his if he took it? He was not involved in the original investigation and the second had just started. No reason to take it unless someone told him to. It makes more sense that someone involved in the original investigation took it, probably to pull notes/GPRs damaging to themselves.

Ok, dumb ass, you missed the point. Now a days there is no gray areas, only black/white while doing this job. Buy if you had any time on the job,you had the opportunity to do the right thing in some gray areas. With today's phones/cameras, a public that doesn't like us, bosses that are too afraid to back us,the things we did in the gray areas would get us indicted now. Are you following along here or do I need to draw a picture, simpleton?

BTW-Nowhere in the original post did I place any of these guys on a pedestal to be admired.

IAD is taking applications, you might want to look into it, since you are so squeaky clean. Rat.

The old adage: "Let sleeping dogs lie" should have been the mantra for this case. Two top notch Area 5 detectives flat out refused to do anything with this case after Dean "The Queen" Andrews asked them to. That should have been the end of it. But for whatever ridiculous reason The Queen wanted some thing done with this case. So some how he enlisted two other detectives from Area 5, Gilger (a very seasoned and well respected detective) and Spanos (who at the time was not very experienced)to re-investigate this case. Of course The Queen neglected to inform Gilger and Spanos that two other very experienced and intelligent detectives absolutely refused to get involved in the case, instead telling Gilger and Spanos "they were the very first team of detectives he thought of to conduct this investigation". It wasn't until Gilger and Spanos finished their investigation that they found out about the two detectives who were asked first and basically told Dean Andrews to go fuck himself. And thus the end result played out just like many thought it would. The Queen is gone with his hefty pension, while the detectives will suffer.
