Undercharging

With Garry pointing out (correctly) that the courts are dropping the ball on charging and sentencing, you'd think that something like this might be a thing of the past - nope:
  • 2 people shot 3000blk of Lexington, car chase with offending vehicle 2 guns tossed out of car(great job of pursuing vehicle to see it and call it out, both recovered), 1 M4 still in vehicle after it crashes near ogden and California, 3 offenders bail and are taken into custody inside the park. Great response by police from 010 and 011. 3 weapons recovered from a vehicle and offenders who had just tried to add plenty of extra holes in some not so upstanding citizen(over 20shots fired from all three weapons). Great case right? Attempted murder? Agg discharge? Multiple AGG UUW charges for all involved? Not here in crook county! Each of the passengers only got 1 charge of AGG UUW, and the driver of the shit show only got a charge for AGG Fleeing and eluding. Funny thing is the driver will probably the only found guilty and do any time. Just as the media is calling for more action to stop the violence the beautiful people at Anita's office are afraid to do their part in putting the bad guys in prison.....
We realize the difficulty of putting a gun in each occupants' hand in terms of a court case, but really? Three guns, three heads. Even if the driver was only driving, they're all accomplices in an attempted murder of two individuals, regardless of the "victims'" rap sheets. The law allows everyone in the car to be charged with murder, why not attempted murder? Aggravated UUW? Pile the charges on and let them take their chances at court. If you can prove they're gangbangers and part of an organized criminal conspiracy, why not RICO them?

You got it all wrong instead of sending them to jail send them to a firearms training course so they actually kill the intended targets instead of killing the elderly or children. We need more of them murdered not just wounded, wounded cost the taxpayers to much money.

3 Guns in the car they all knew what they were out doing.
Wyoming v. Houghton
" Also, passengers in cars are more likely engaged in a common enterprise with the driver and have the same interest in concealing the fruits or the evidence of their wrongdoing"
and
What about Maryland v. Pringle?
"Therefore, the Court found it reasonable for Officer Snyder
to ‘‘infer a common enterprise’’ among Pringle and his companions
because ‘‘[t]he quantity of drugs and cash in the car indicated the
likelihood of drug dealing, an enterprise to which a dealer would
be unlikely to admit an innocent person with the potential to furnish
evidence against him."

Don't be silly. Assuming they were minorities, there are already to many minorities in jail/prison. It costs to much of the tax payers money to go to trial and then store them in jail/prison for years and years. While in prison/jail they are not being productive. What is needed is to change the political system in this country.

Control those guns Rahm and put these three "concealed carriers" in jail first for a long time before any more of your BS gun control talk.

Why not RICO them?

Because this is Cook County. Where the politicians rape the citizens and in return the citizens get the occasional payout.

Even GARRY and his bloated salary gets that.

If they did not die. The victim, who go shot, has to sign complaints. That is why someone isn't charged with attempted murder.

This is what we're beefing about. Rahm making all kinds of brave "take it in the alley" noises, and then you get a totally wild-ass "domestic terrorism"-type multiple shooting and chase, guns coming out the window -- and an M4 still in there -- and you get a mouse-squeak from aforementioned alley, mere agg UUW.

Do they have to be waving an ISIS flag before anyone will do something?

Rahm, Alvarez, Preckwinkle, this is your time to shine. If you'd just USE THE LAWS WE HAVE, you'd not see this crew again for a long, long time.

Or are you all just full of s__t?

McCarthy full of it too --

"The police superintendent said tragedies such as the one that befell this Back of the Yards family will continue to happen until there is adequate legal recourse to prosecute violent criminals."

USE THE LAWS WE HAVE, and it's "next stop, Menard" for this kind of thing.

What is wrong with these people? Always affecting to wait for just one more "good first step" while ignoring the whole staircase that is already there.

...unless we need a massive Federal investigation and clean-out of aldermen and ASAs with gang ties?

Is that it?

Can I get an event number for an el check at Harrison and Kedzie blue line please. Oh wait squad there is a chase going on a few blocks away, let me get lunch in the station please.

See here is the problem folks. Cops did everything right. Cops did their job and all four will be out again in no time. The offenders will get out and be free to create violence again and cops will be blamed for this again. The only thing that will prob stick in this case is the driver prob had a suspended license and will get time for fleeing and eluding. Just shows you how freaking stupid it is to do any police work out here. Oh and just remember this, go get more contact cards, that will stop the violence. No one gives a phuck about this good arrest but officers why don't you get more contact cards.

Anita, Preckwinke, crook county judicial system so corrupt, so scared to do the jobs for the huge paydays! Crime is way out of control, police are decimate we need what at least 4,000 to bring up to strength? Listened to wls this morning big John Howells show, Deano was on and he said that coppers are being worked to many days, he then said "i recently talked to a young officer on a tactical team, he told me he had 28 days off cancelled this year and he did not have enough time with his kids!" yes that is what was said! Hey now young copper "skull full of mush" calling FOP president to complain, that's a punk move, many coppers want the extra cash, simple thing to do young copper GET OFF TAC go to beat car regular hours but then no cool blue jeans, backwards cap and short easy ducks! Thanks also for embarrassing other coppers, with deans statement we make a good wage and the extra helps living in the city with private schools etc... Now go cry to mommy!

Dean that was a "punk move" saying that on a 50,000 watt radio station broadcast everywhere, makes coppers look like cry babies having to work extra! we don't work regular hours, but we are paid well! BTW Dean Mike Lappe is going after disability coppers that can work did you stop the nonsense theft of taking disability pension checks yet? Your perfectly capable of working correct Dean??

The whole staircase is about as tall as the Hancock Building, but we have POLITICIANS in place, not intelligent, inventive, engaged prosecutors and judges.

Because this is cook county. It does not follow the law of the state of Illinois. It is not probable cause, its whether you can get a conviction. Darren O'Brien told our Dets class that back in the early 2000's and nothing has changed. You also have to be mindful of upsetting the Democratic voters. We wouldn't want too many people of color in jail. Who would vote Democratic then?

What is the background of victims and family
Good chance over 50 %are gang members , receive welfare , single parent homes ,
This is a social problem
Let these folks move in neighborhoods of the judges , probation ,parole boards , defense attorneys , politicians that encourage free everything . Then and only then will these folks have a chance .

You can't jail them! You can't put them in prison! What the heck are you thinking! You are filling up the gangbanging-to-prison pipeline! Too many of our young urban youth who are turning their lives around, and getting their GED, and bringing Pampers to they babymamas, and studying to be a rap star are going to prison!

You need to find some way to make all those guns magically evaporate!

Undercharging and being overgenerous with plead out is something you've highlighted again and again, SCC. Ironically in the upcoming State Attorney's race, Anita is out of favor with the machine for being too focused on crime and punishment. Everybody else in the race is touting 'restorative justice' rather than public safety.

Mick Dumke piece on Anita piece going at this angle for great length, making the often made point that frequently non-violent offenders end up jailed for long stretches to nobody's benefit. Well, what about violent offenders? Too often in Chicago they get a slap on the wrist at best.
