We Give Up

  • Cook County State's Attorney Anita Alvarez will hold a news conference Monday to announce reforms to low-level drug offenses, including dismissal of all future misdemeanor marijuana cases, a spokeswoman said Sunday.

    "If someone is caught with a misdemeanor amount of marijuana, the state's attorney's office will no longer prosecute that case," Alvarez spokeswoman Sally Daly said. This program will be for people with less than three arrests or citations, she said.

    The announcement, scheduled for 10:15 a.m. at the state's attorney's office, is part of the sweeping overhaul that will also address how the office prosecutes small amounts of recreational drugs including Ecstasy, cocaine and heroin.

    Alvarez is expected to detail the creation of an alternative prosecution program aimed at diverting nonviolent, repeat drug offenders out of the criminal justice system, her office said in a news release Sunday afternoon. The program, designed for those charged with Class 4 felony possession — currently punishable by up to a $25,000 fine or one to three years in prison, or both — will attempt to address chronic drug use and addiction as a public health issue. Repeat offenders are expected to be linked with social service agencies for treatment rather than face criminal penalties.
When you reward bad behavior, you get more of it. If we're around in a few years, we may revisit this and note the upward trend in so called "recreational usage" of weed and harder narcotics under the Alvarez regime.

How about following the Law as written? And if you don't like it, stop being a Dart and work to change the Law instead of unilaterally disregarding it. Who does she think she is? Obama?

Hey let do the same for shop lifting, theft and burglaries. Anything under $100 and fewer then 10 arrest, the case is dismissed. The offender is required to attend civic classes and perform 40 hrs of community service. This type of crime fighting to catch on. Next will be Simple Assault, what the heck, saying you are going to kick someone's ass should not result in an arrest but an ANOV. Of course anyone with 10 or more arrests will still be eligible for probation, maybe even double probation.

I see a snowball effect here. The only reason a hype with a rock or a blow gives up a search warrant on their dealer is because they don't want to sit in County for 3 weeks until their court date. No threat of County jail, no motivation to snitch. Good drug arrests are all made because someone snitched. So more drug dealers will sell with impunity. And on tact teams we can't pay/register informants. I guess I'll just write ANOVs and contact cards and say fuck police work.

Who's gonna pay for this. Regardless, it's cheaper to house a doper in jail then it is to keep them in some sort of extended drug rehab program. Those that are recreational users are rather functional members of society and are most likely not going to get arrested every weekend. The habitual users are the one's committing crimes in order to pay for their habit. Besides drug programs are just another place to make connections especially for the recreational user. Just another way for the liberals to zombify the nation to keep their voting block intact.

Does it really matter? The States Attorney has been picking and choosing which cases they will prosecute for years. Not based upon the evidence or merits of the case but instead based upon who the defendant is, who he/she knows, who has made a phone call on his/her behalf and how the ASA feels that day.

The State's Attorney's office hasn't prosecuted midemeanor marijuana arrests in years. Every case has been Nollie Prosse. Only now they are "officially" stating their intentions. As for the small amounts of harder drugs, the ASA's go through the motions but the judge always finds No Probably Cause unless there is at least a certain weight to the amount recovered. The whole system is a joke.

Have to agree with you. After a lifetime of law enforcement I now believe that drug use is a medical problem. Locking up drug users does no good whatsoever. Legalize drugs? Never. But, put the user into rehab programs.

They're removing the clash between illegal and legal marijuana sale by letting the gangs and drug dealers continue to operate without fear of prosecution. THerefore, those who can get MJ leagally will line the pockets of the clouted and those who can't can continue to get it on the street. She simply bypassed the legislative process. No prosecution means the police aren't going to take the time or trouble to enforce the law. This means less arrests. Less arrests mean our government leaders can boast how drug usage has decreased since Hippa laws will not allow the dissemination of medical treatment information. THe politicians can then boast how we are winning the war on drugs. In the meantime, officers still get to wade through the carnage since drugs will still prevail on the streets. Stay safe officers. You are all in my prayers. You now face a battle on two fronts: the criminals and now those who make laws and are supposed to prosecute the lawbreakers. God help you!.

A close friend is an ASA. He says the exact same thing. The number of arrests and convictions that a person needs to go to jail on a small amount charge is exhausting.

The best part of this announcement is that she made this on 4/20. No accident, of course. Nope, none.

As in.. not once have we let a white person go who had narcotics on them unless they ratted something good. And I know my partner on his old team didn't either. It will be completely legal sooner than later. Too much potential tax money. Take a look at how much Colorado is raking in. And really, is it so bad? Much more carnage from alcohol. And tobacco.

I do agree that the SA should enforce the laws as written. Shouldnt make unilateral changes. The legislature should act and quit the charade.

These "recreational" amounts of controlled substances don't just appear on the streets. They are trafficked by armed, violent groups that when confronted by law enforcement officers demonstrate no concern for the safety of the officers or the public. Simply refusing to prosecute cases based on anything but a new or revised law is a slap I the face to all law enforcement officers that work in the path of those trafficked narcotics, but also the citizens whose safety is jeopardized by the actions of these traffickers and street peddlers.

How does this one make sense? Since when is the CCSAO allowed to in effect change laws. PCS is a felony. Convictions result in jail time. Nothing in the sentencing allows for drug rehab. She can't just pick and choose how the law is enforced (even though they have been for years now.) I don't know of any conflict with anyone's rights that would require her to stop enforcing PCS or 550/4 (like UUW/CCL vs 2nd amendment). She wants the law changed she has to go thru Springfield. That office is to prosecute all matters brought before them by officers of the court, PERIOD! This does not make sense! The possession and use of cannabis is illegal, and it is illegal for a reason. Your personal choices and personal opinions do not matter, nor do mine. Marijuana contains a chemical that has been outlawed in this country for decades. It is a stepping-stone drug that has been factually determined to be a precursor for other criminal activity. Moral and social consequences aside, basement drug or not it is and should be outlawed, and Mrs. Alvarez has no authority and no basis other than a self-serving agenda to undermine the law or the demands of the dominant number of citizens whom she serves.

Explaining to the media that her office had made such a good case against the detective. She is way out of line. Judge Dennis Porter, in a directed verdict Monday, ruled the state had failed to prove recklessness on the part of 46-year-old Officer Dante Servin in the March 2012 shooting death of 22-year-old Rekia Boyd. Alvarez is just as bad as Sharpton and Jessie, inciting. She is truly scum.

While I believe weed ought to be legal for adults over 18 who aren't operating vehicles or heavy machinery while stoned, this is well beyond her Prosecutorial Discretion. Her role in the whole legal system is to uphold and enforce the law by prosecuting offenders. Defense lawyers defend defendants against those charges. Judges and Juries weigh the evidence and choose to hold the defendant guilty or innocent, or to nullify the charges brought by the Prosecutor.

By refusing to uphold the law, she's making herself judge and jury.

She ought to be arrested, brought up on charges, and have her law license revoked.

She was definitely unhappy with verdict! She was basically saying "it's not my fault" no Anita your response should of been " servin was tried in a court of law the judge ruled" move on to next case! Don't inflame anything please!

On another note what happened to the "broken windows theory" where arresting ticketing for smaller crimes helped prevent larger crimes? Guess that does not apply here correct Anita? Did Toni take you into the back room and order you to do this? Was you budget cut because of the savings of not needing your services? Let's see less police, less prosecution, less going to jail, nah can't be a recipe for more out of control crime can it? Sorry I'm just being sarcastic!

While I am personally against the use of Cannabis (I hate hearing it called marijuana), I also think that we over prosecute. Our society has over criminalized many behaviors and have caused the justice system to become bloated. Fines for Cannabis in small amounts okay. For larger amounts or selling, arrest is appropriate.
