That Was Quick

  • A Chicago police officer has been disciplined after he admitted playing a song some consider racially offensive during a protest against police violence last weekend, the department announced in a statement Thursday.

    The action was taken after a video surfaced apparently showing a Chicago police car blasting the song “Sweet Home Alabama” by the band Lynyrd Skynyrd during the Saturday protest.

    In the statement, the officer said he was playing the music as a "fan of the University of Alabama," which was playing the University of Missouri for the SEC championship and a shot at the NCAA playoffs.

    But the department said it "fully understands sensitivities related to the song and, regardless, we cannot condone any behavior that may be viewed as disruptive or disrespectful to any protester or resident."

    "CPD is dedicated to ensuring residents' right to free speech and peaceful assembly," it added.

    The officer will be suspended for 10 days pending the approval of Superintendent Garry McCarthy, according to a source.
Someone want to explain to us how this violated anyone's right to free speech or assembly?

Juvenile? Ill-timed? Misuse of Department property? All viable accusations. Violating First Amendment rights? Not even close. Racist? Not if you ask the guys who wrote and performed the song.

And all wrapped up in five days? That must be some sort of Christmas miracle. Was anyone even served with papers? Upon service, you have 72 hours to respond...that's three days right there. Closing paperwork? Command Channel Review? Sounds like a railroad job to us.

NOTE: anyone accusing us of reflexively defending the officer will have their comment deleted. Supposedly, he admitted it, but there's still a thing called "due process," even for disciplinary issues, and it certainly doesn't look like it was followed. You don't shortcut the system for political reasons - that's a horrible precedent to set. That's how contracts get abrogated.

Dumb question, does the officer have any legal recourse? Could he file a suit or perhaps a grievance as there was zero due process? There is no way that is prohibiting or violating ANYONE'S first amendment rights. That is just kowtowing to the black community is all that is. 10 days seems a little exorbitant if you ask me. For playing a song? The shitbirds fly down 111th and 115th streets blaring their offensive thug music during their funeral processions, yet the neighborhood can't complain and state that it's infringing on their peace because NOTHING is ever done about THAT. When will this madness end? The officer needs a 10-1 benefit. It should be Skynyrd themed.

This is what happens when you have unsupervised kids playing police.

They know how to do bullshit 3 bag weed pinches and ANOVs for open beers all day long with their eyes closed, but aren't smart enough to keep their mouths shut when the shit hits the fan.

PROBLEM: most of today's tact teams don't have senior officers to lend experience and guidance to the Hair Gels with every day stuff like policy and procedure, nor are they around to help/possibly prevent Officers Baseball Cap and Blue Jeans from stepping on their dicks. The older guys saw the writing on the wall and got out while the gettin' was good.

PROBLEM: 98% of the supervisors on the job today are spineless punks that will leave you twisting in the wind when the hammer drops. I'll bet this guy's sergeant and/or lieutenant told him to just 'take his medicine' because they don't want THEIR little worlds interrupted. But no doubt they had a lot to say and no problems asking this guy to bring in the numbers.

IAD must've rattled his cage pretty good to get him to spill his guts and accept a 10 day whack while foregoing the formal CR investigation process. Does this kid not know that he has contractual protections? I hope to God he called FLOP before signing off on anything. And if he DID call FLOP, is this what they told him to do? Does this kid know that Stuporintendent McGunmagnet can increase the recommended 10 day penalty when it hits his desk for review? Ask around, young man - the Supe has been doing just that, and with alarming regularity.

You are 100% correct, SCC. The Bossholes and IAD rats pushed this kid onto the sword of political expediency at the direction of Tiny Dancer and the Stuporintendent, fearing repercussions from the likes of Pfather Pfaker, WifeBeater Hardiman and Jesse Jackass. They don't want those pesky protestors floating around downtown exercising their First Amendment rites any longer than they've already been.

As far as abrogating the contract? Two-thirds of the Lodge 7 membership that cast ballots at the conclusion of contract negotiations pretty much did just that.

End of the day I learned that :IF you do your job the way you are trained and in a professional matter; you are good... I am amazed at what "offends" people these days. While it was stupid, it didn't rise to this level, 10 days? I always thought the song was a catchy dig at Neil Young. who knew it was so "racist".

That being said, a benefit? Nope. Not for this. Like I said, it was dumb. Let him take his lumps. When he gets jammed doing police work, I'll buy the ticket.

I figured that was going to happen. I am not sure what the officer was thinking. In today's climate I would not do anything to draw attention to myself. This kid will probably be dumped back to the watch and remain there for a long time. this incident will be held over his head for the rest of his career. He is dubbed a racist by the masses and anything he does will be scrutinized. I hope this kid goes back to watch and does nothing but answer his calls. No extra work for the department. Times have changed and if you are a white officer you are going to be made an example of when it comes to this kind of stuff. I don't know the race of the office but of this were a black officer would they believe his story about supporting the University team? Would this even be an issue?

I really get a pathetic laugh out of stories like this. My wife and I are white. My wife's best friend and roomate from college is black. She is from Alabama, born and raised. He favorite song is "Sweet Home Alabama". She would be insulted along with the majority of people from Alabama that anyone would get suspended for playing that song.

Political correctness has ruined this country. When perception is the only reality we have, we are finished. Maybe the University of Virginia can shut down all Greek life after somebody lied. Thats right they already did

If it was handled through the CR process he would get served then have 72 hours to respond, but if they handled it through a SPAR, it could easily be done in a couple days. CRs stick around a very long time. A spar is taken out of the system one year after it hits the system.

Sounds to me like the officer threw his mercy on the court and agreed to whatever punishment was recommended.
If this is true, you're right SCC, he undercut the rest of us. Let them serve you, request counsel and answer the beef. Appeal any punishment if you feel it's excessive (or warranted at all).

I used to get stuck doing a school dismissal at a particularly problematic south side school which was known for it's afterschool fights.

Be visible, park right at a crossing corner and be there if the shit hit the fan.

There would be the daily posturing and bullshit by the little darlings. The look at you and spit, the bird flip offs and scowls, etc.

But my squad had a totally misaligned windshield wiper solution jet. To get a better look at the possible future troublemakers I would clean my windshield. One jet would hit my windshield and the other one was like a mini super soaker shooting straight out from the car.

The 'Awww mannn's" elicited each day still put a smile on my face.

Imagine a boss trying to admonish you. OFFICER!!!! ARE YOU AWARE OF WHAT YOU JUST DID THERE!!!

No conspiracy, just read the contract:

Section 6.12 — Mediation.

At any time during an investigation, prior to an accused officer giving a statement, the parties may agree to mediate the resolution of the Complaint Register investigation. The “parties” shall mean the accused officer, with or without his or her Lodge representative, and a representative of IAD or IPRA, as appropriate. The IAD/IPRA investigator assigned to the case will not be present at the mediation. Prior to the mediation session, IAD/IPRA shall cause the accused officer to be served with a Notice of Administrative Rights and a Notice of Charges and Allegations, which will include the rule violation and the factual basis therefore. Neither party is required to meet. The representatives at the meeting shall discuss the allegations and IAD’s/IPRA’s position regarding the finding of the case. The parties shall discuss whether they can reach accord as to a disposition. By accepting the discipline, the accused officer is waiving his or her right to grieve or appeal the decision, and the accused officer is not required to submit any statement or response. If the accused officer does not agree with IAD’s/IPRA’s position, the disciplinary process will continue as designated.

Statements made and information relayed at the mediation which are not included in the file will not be used against the officer or included in the file at any later date.

If IAD/IPRA and the accused officer agree on a penalty less than separation, it is binding on both parties. However, the Superintendent retains the right to seek the separation of an officer.

Let start by saying this is bullshit and he shouldn't be disciplined at all, OR perhaps minimally for getting caught improperly utilizing Department equipment. With that said.... There may not have been an investigation, it possibly was done through the spat process. The spar can be satisfied with up to 10 days and doesn't require a lengthy investigation. Some will see it as a sgt or lt throwing him under the bus but others will see it as an attempt to avoid an IAD investigation with the potential to hit him with 20 or 30 days for political purposes. He may have come forward and said uh oh! And his boss said lets cut and run. Sit quiet and hope they don't identify? Drag everyone out there through an investigation? Wait for the political and media bullshit to heat up? YOU DECIDE what was right.

It seems like you're using a very tight definition of violating someone's right to free speech/assembly. It certainly isn't a huge stretch to interpret a cop blaring "Sweet Home Alabama" (a song, that while perhaps not racist itself has been co-opted as a Confederate nostalgic anthem) while trailing a procession of mostly black people protesting police violence against minorities as a form of intimidation or, at least, as a "Fuck you, we don't care about your concerns.", either of which, I think we can all agree, are unbecoming of a police officer.

I'm no expert on police disciplinary procedures, but isn't it possible that IAD or whoever sat him down, pulled this up on YouTube, and that, faced with pretty damning evidence, the guy just decided plead "no contest" and decided fighting it wasn't worth the hassle?

If it was handled through the CR process he would get served then have 72 hours to respond, but if they handled it through a SPAR, it could easily be done in a couple days. CRs stick around a very long time. A spar is taken out of the system one year after it hits the system.

As a cop, I'm sorry to say, but you don't have the same privileges per-say as a citizen during or even after your shift. You represent CPD, not yourself. If CPD doesn't agree, then you don't. You serve the public, if the public has a problem with what you are doing, then it can come back and bite you in the ass sometimes. That's just the way it is. It's like how racists on social media get fired from their job even if they weren't working the day they decided to be racist on social media.

the black protesters in the video even seemed nonchalant about the song. Now, I'll admit, I'm a eric garner supporter, but not a police hater. With that being said, SCC posted that it seems the song was "added in later" and not actually playing out of a squad car. I BELIEVE that. I'll grab my tin-foil hat now and say I also don't even believe a real cop was actually disciplined. Seems like they are just telling us one was. The nonchalant atmosphere in the video and the points SCC stated in this post lead me to believe that a song wasn't playing.

Sweet Home Alabama is just like the Confederate flag (that black rappers from the south even have in their music videos sometimes). It's one of those things that isn't supposed to be racist, but it just gives off that vibe because of how it has been used throughout the years.

Let start by saying this is bullshit and he shouldn't be disciplined at all, OR perhaps minimally for getting caught improperly utilizing Department equipment. With that said.... There may not have been an investigation, it possibly was done through the spat process. The spar can be satisfied with up to 10 days and doesn't require a lengthy investigation. Some will see it as a sgt or lt throwing him under the bus but others will see it as an attempt to avoid an IAD investigation with the potential to hit him with 20 or 30 days for political purposes. He may have come forward and said uh oh! And his boss said lets cut and run. Sit quiet and hope they don't identify? Drag everyone out there through an investigation? Wait for the political and media bullshit to heat up? YOU DECIDE what was right.


Seriously? This is exactly the same bullshit they pulled in Ferguson and NY, with their "Grand Jury". ANOTHER COVER-UP. Thank you for bringing this to my attention. Subverting the real process. Thank God Eric Holder is in Chicago and I alerted him to is blog. You racist bastards.

Sorry boss for doing what I was hired to do, be the police. I easily could have sat back after coming home from Iowa. This is the career I chose. If at any point I become a sit on my hands kind of police officer I will just quit and find something else to do. I'm not a police officer so I don't know how "due process" works but if I would have pulled some sh¡t like that at work I would be suspended if not fired. granted my line of work requires me to work with customers paying for our services, and so the dynamics are quite a bit different. I also don't put my life in danger by going to work.

I was just surprised at the backlash against the "harshness" of the suspension and the folks trying to justify the police officer's behavior. my company would not be interested in what my "intentions" were by playing that song or what lynard skynards intentions were. in the non-police world, that type of behavior is simply not tolerated.

I don't know if I believe the claim that officer was a Alabama fan. That being said, I don't think the department should have acknowledged it was offensive or potentially racist. I think there may be merit to discpline for improper use of CPD property, but to paint this situation that it was racist is bad PR for the CPD. Come out and announce the officer is being reprimanded for improper use of Govt property, but don't feed the race baiters. They should not have made assumptions about reasons, stick with facts and what was improper use of equipment.

So what would be wrong with a song like the Ramones' "Beat on the Brat"?Nothing racist about it, and the lyrics don't imply anything about any individual being beaten, just an anonymous brat.

I'm obviously not a cop, just a civilian who appreciates what you do.

If some people would get it into their heads that it's much better to do what The Police ask them to do, when they are asked to do so, there would be much less of this kind of nonsense going on.
