Suspect Released to Rape Again?

  • A 20-year-old man was caught on multiple surveillance cameras before and after he allegedly raped and robbed a woman in broad daylight Tuesday afternoon in Lakeview, prosecutors said in court.

    Marcus Lynch, of the 4700 block of South Loomis Boulevard, has been charged with aggravated criminal sexual assault and armed robbery.

    Lynch was denied bail Wednesday afternoon, after prosecutors told a judge he’d been caught on camera following the a 22-year-old woman after she left a Circle K convenience store at a Shell gas station at Halsted and Addison streets around 4:30 p.m. Tuesday.
Nicely done.

However, this case triggered a few memories of our readers, and it appears that Marcus enjoys having sex at knife-point with unwilling females. In fact, he was arrested on 13 December 2013 on another CSA where he detained and raped a female at knife-point, forced the victim to give him her phone number, called the victim while she was being interviewed by the police for another "date" and was apprehended where he told her to meet him.

Slam-dunk Criminal Sexual Assault, right? Not according to the State's Attorney who refused to approve felony charges that probably would have kept this animal behind bars and prevented the most recent rape. The case was initially listed as "continuing investigation," but was shortly followed up by a refusal of charges.

But you can bet Anita won't be asked any questions about that one.

And there's the rub! No pun intended.

ASA frequently "CI" cases they do not want to pursue or are too afraid to make a "go/no" approval or rejection on. Frequently they did this for shootings an other violent crimes forcing detectives to suspend cases "pending further evidentiary discoveries" allowing criminals to walk the streets.

Their little "winability" scale imposed by their trial supervisors changed weekly and makes it impassible to conduct an investigation. It supposed to be the letter if the law, but they impose a "spirit" of the law when making these "CI" decisions.

Felony review has to go. No longer do we need them. Their scale does nothing because they mostly lose the cases they think they'll win and just creates a negative relationship between the PO and ASA.

Well lets think about this some more...this guy who has ALLEDGEDLY committed the offense DIDN'T actually use the knife right? And besides who knows if the knife was even real? It could have been a toy.

Not only that, the young man has had a difficult life. His parents were not the type of parents they should have been - his parents weren't even around. That's not his fault - that's society's fault. Where was societ all his life? He is only acting out in an attempt to get help. This is a cry for help. He deserves a more than this. He deserves a link card - he can't get work because our economy is in such bad shape - this isn't his fault.

How fucking ridiculous right? But isn't that what we've become? A State that has MORE protection, rights and benefits for the scum that we live around? Remember when punishment, long sentences, the prospect of living in prison, death penalty, etc. had a deterrent effect on criminals? No you don't. None of us do. Justice occured when our grandparents were kids.

You know the "Lady Justice" statue right? She's gone. That statue has been toppled a long time ago by people like Anita.

OT: Much of McCarthy's tenure that the media discuss his crime strategies (or lack there of). For one, most of what McCarthy is doing was in the original CAPS program. So, we now send a mass email regarding a shooting - we called it a flash message 10 years ago. Based on the emaisl, how many offenders have been nabbed? None.

But what goes under the radar is McCarthy's poor management style and the cost to the city and pension funds. He is by far the worst Sup in terms of holding exempt staff accountable and that is the basis of CompStat.

1. He has not dumped a commander for poor performance - he simply moves commanders. Cmdr of 014 (Flores), 019 (Kenny) and 020 (Moy) all moved to headquarters. How many commanders are at headquarters? How many XOS, Directors/Deputy Directors are there? It is a complete waste of taxpayers dollar and abuse of the pension fund.
2. We now have two district commanders as deputy chiefs. Another waste of taxpayers dollars and abuse of the pension fund.

He is afraid or does not have the power to dump someone? Is Rahm that afraid of the next election? If the commander of 007/004 are so impressive to a deputy chief, then dump the area south deputy chief and put one of them in that position.

His management style has cost the city millions and future millions and the results are still not better than Weis.

CPD Detectives are just being used as a Scapegoat by the Crook County States Attorney. It is not a Detectives job to have a counter to each and every future question that might be brought up by an Offender's Attorney or Public Defender in a Trial. Detectives are there to establish that a crime worthy of Felony Charges [Indictment-NOT Guaranteed Conviction] has quite possibly been committed, not to assure that the States Attorney will get absolutely no flack at all in a Trial. These Assistant States Attorneys want every i dotted, every T crossed, before they will Charge with a Felony. Meanwhile their own States Attorney Investigators are busy walking the States Attorneys Dog, delivering Subpoenas, trying to locate more witnesses to the point of overkill, and not really doing much real investigating. The States Attorney's Office takes the Lazy Way Out, and dumps on CPD Detectives, who are expected to make sure everything is just perfect and every single aspect of a criminal investigation is covered before an Assistant States Attorney will 'grace" them wih Felony approval. . Many, many more of these Mutts would just plead out, if they were only charged properly, with a Felony, by the States Attorney's Office, without everything having to be absolutely perfect, to the point of rediculousness.. The Crook County State Attorney's Office is riddled with incompetence, malpheasance, and politics. It needs a total re-vamping, and new leadership, as it is just another politically motivated, lackluster, Disfunctional, bloated Crook County-Chicago Agency. Walk a mile in a real CPD Detectives shoes, and you will get an eye-opening view into what it's like to bash your head repeatedly into a brick wall, in order to appease these Assistant States Attorneys into approving Felony Charges for anything. I guess the States Attorneys don't want to overwork any Crook County Judges with actually trying more cases, so they all don't miss their Tee-Off times.

On more than one occasion I've had a ASA not want to give me their name for a refusal of charges. Only after I asked to speak to a supervisor did they relent. They try to give you some bullshit like. " well you don't need my name cause this isn't really a refusal" your either approving felony charges or your not. Grow some balls and make a decision.

You know most states attorneys and detectives are able to work together. Most people in our professions are smart enough to do or jobs and speak to others with respect. When one states attorney makes a mistake we don't criticize the entire office and when one detective fails to do his job we don't go and say all dicks are stupid. The problem with the system is morons like the ones commenting on this blog who criticize everyone around them instead of turning the lens inward. Also, cops of all people should know that the media never, ever reports on things 100% accurately. They wouldn't make headlines that way! Get over it. Let's work together.

A little under 4 years I believe. I spent over two years playing games in Federal Court and the 7th Circuit Appellate level for doing nothing to my arrestee except arresting him with probable cause.

Was previously unimpressed with him, but if he fights TD 9.5 and sticks up for us, Reilly has my vote when he runs for mayor.

I can believe it. ASA's from felony review sex crimes are mostly assholes. You can have all the proof in the world and they want to CI or reject charges. Was on the phone with the supervisor more than once before I could get charges approved. With sex crimes unless you have reliable witnesses, a confession or a DNA match, you were shit out of luck. Even with a great case if the victim had any negative past, they shit canned the cases. Any other county charges sex offender with less than half the evidence. As everybody knows, if the ASA's office is confronted, it was an improper investigation done by the Detectives. Too bad the press can't see that felony review won't approve charges unless it is a case that the offender has no chance of not being found guilty. Felony review judge the cases, not review them.
